GENERAL TERMS OF USE AND SALE

GEnEral terms of sale

These general terms and conditions of sale (hereinafter “GTC”) govern all sales concluded between MotorFlame (hereinafter “the Seller”) and any individual or legal entity (hereinafter “the Customer”) wishing to purchase a MotorFlame fireplace or any other related product.

Any order implies the Customer’s full and unconditional acceptance of these GTC.

ORDER

  • The order is confirmed only after full payment has been received.

  • For Custom Limited models, the Customer must approve the plans, dimensions, and specifications, and then pay to initiate production.

  • The Customer is responsible for the accuracy of the information provided (contact details, addresses, preferences).

PRICING AND PAYMENT

  • Prices are displayed in U.S. dollars (USD), with applicable taxes added.

  • Shipping fees are charged separately and cover transport only to the Customer’s nearest depot.

  • MotorFlame reserves the right to change its prices at any time, but the prices applied will be those in effect at the time of the order.

  • No product will be shipped until full payment has been received.

SHIPPING

  • MotorFlame fireplaces are shipped on standard 4-foot x 8-foot pallets, with an average weight of approximately 700 lbs.

  • Transportation is provided only up to the nearest partner drop-off center to the Customer.

  • Once delivered to this depot, the responsibility for transport and handling falls to the Customer. The Customer may choose to:

  • Pick up their product directly at the drop-off center,

  • Or organize final home delivery with the transport company at their own expense.

  • Delivery times are provided for informational purposes only and may vary depending on availability and carriers. MotorFlame cannot be held responsible for a delay beyond its control.

RECEIPT AND TRANSFER OF RISK

  • As of the handover of the merchandise to the drop-off center, the risks associated with transport and handling are transferred to the Customer.

  • It is the Customer's responsibility to inspect the product upon pickup and immediately report any apparent damage or loss to the carrier.

RETURNS AND CANCELLATIONS

  • Standard products (Regular, Deluxe) may be returned within 14 days from the date of receipt, provided they have not been used, damaged, or modified.

  • Return costs (shipping, handling) are the responsibility of the Customer.

WARRANTIES AND LIABILITIES

MotorFlame warrants that its products are free from manufacturing defects and conform to normal use.

The warranty does not cover:

  • Normal wear and tear,

  • Damage caused by improper installation, inappropriate use, or lack of maintenance,

  • Modifications made by the Customer.

MotorFlame's liability is limited to the price of the product. The Seller shall not be held liable for any indirect, material, or immaterial damage.

PERSONAL DATA

  • The information collected during an order is strictly confidential and used solely for the management of the Customer relationship (invoicing, shipping, after-sales service).

  • MotorFlame undertakes not to transmit this data to third parties, except in the event of a legal obligation or a logistics partner related to delivery.

UNFORESEEN CIRCUMSTANCES

MotorFlame undertakes to deliver the ordered product to the drop-off center agreed upon with the Customer. Up to this point, MotorFlame assumes full responsibility for the shipment. Once the merchandise is received by the drop-off center, the responsibility for transport and final delivery falls to the Customer and/or the carrier chosen by them. In the event of unpredictable and irresistible occurrences (such as natural disasters, fires, major accidents, strikes, etc.) happening after delivery to the drop-off center, MotorFlame shall not be held liable for delays, damages, or losses.

GOVERNING LAW AND DISPUTES

These General Terms and Conditions are governed by the laws in force in the province of Quebec. Any dispute relating to their interpretation or execution shall be submitted to the competent courts of that jurisdiction.

By ordering from MotorFlame, you agree to these terms. They are intended to protect both our customers and our company while ensuring a clear and transparent shopping experience.
